These terms apply to all services provided by Publish Spark to authors and other clients.
1. Acceptance of Terms
By engaging Publish Spark, requesting a free manuscript audit, or using this website, you agree to these terms. If you do not agree, please do not use our services.
2. Services Provided
We provide ghostwriting, editing, cover design, interior formatting, publishing and distribution setup, book marketing, and manuscript audits. The exact scope, deliverables, schedule, and price for your project are set out in a written scope document agreed before work begins. That document takes precedence where it differs from general descriptions on this website.
3. Intellectual Property
You retain 100% ownership of your manuscript and of all deliverables we produce for you, including edited text, ghostwritten text, cover artwork, and interior files. On final payment, all rights in commissioned work are assigned to you. Publish Spark claims no royalty, no share of sales, and no ongoing licence in your work. We may reference a completed project in our portfolio only with your written permission.
4. Payment Terms
Unless otherwise agreed in writing, projects require 50% to schedule the work and 50% on delivery. Larger projects may be split into milestones. Third-party costs — ISBNs, stock imagery licences, advertising spend, and platform fees — are billed at cost or paid directly by you. Invoices are due on receipt, and work may pause on overdue accounts.
5. Revisions & Refunds
Each service includes a stated number of revision rounds; additional rounds are quoted in advance. Refunds are handled case by case according to work completed, as described in our Refund Policy.
6. Confidentiality
Your manuscript, materials, and project details are treated as confidential. We do not share, publish, or use them for any purpose other than delivering your project, and our contractors are bound by the same obligation.
7. Limitation of Liability
We do not guarantee sales, rankings, reviews, or income. To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid for the service giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits or lost publishing opportunities.
8. Governing Law
These terms are governed by the laws of the State of New Jersey, USA, and the courts of New Jersey have exclusive jurisdiction over any dispute.
9. Changes to Terms
We may update these terms from time to time. The version in force when your scope document is signed applies to your project. Material changes will be posted on this page with a revised date.
